1. About Business Loans Connect

Business Loans Connect is a business funding introduction and referral service.

We connect eligible Australian businesses with participating business finance brokers and lenders.

Business Loans Connect is not a lender, credit provider, business finance broker or financial adviser. We do not provide loans or make lending decisions.

Our service is intended for businesses seeking finance for business purposes. It is not intended to assist with consumer credit for personal, domestic or household purposes.

Information provided by Business Loans Connect is general information only and does not constitute financial, legal, taxation or credit advice.

2. How our referral service works

When you submit an enquiry, we may use the information you provide to determine whether your enquiry meets Business Loans Connect's initial referral criteria.

These criteria may include matters such as:

• how long your business has been trading;
• business revenue;
• the amount of finance you are seeking; and
• other information relevant to administering the referral.

If your enquiry meets our initial referral criteria, we may introduce you to a participating business finance broker or lender.

Business Loans Connect generally refers a successful enquiry to one participating funding partner at a time.

Meeting our referral criteria does not mean that you qualify for, have been approved for, or have been pre-approved for finance.

3. Our funding partner network

Our participating funding partner network may include:

• business finance brokers; and
• direct lenders.

Some participating broker partners may have access to finance products from multiple lenders, while other participating partners may be direct lenders offering their own products.

Business Loans Connect does not compare the entire market or every lender or finance product available in Australia.

Our introduction of your enquiry to a participating funding partner should not be interpreted as a recommendation or representation that the partner or any particular finance product is the best, cheapest or most suitable option for your business.

You should consider the information, terms and options provided by the relevant funding partner and make your own decision about whether a finance product is appropriate for your business.

4. Funding decisions

Business Loans Connect does not:

• conduct a credit assessment;
• determine your creditworthiness;
• approve or decline finance;
• determine interest rates or fees;
• determine finance terms;
• determine the amount a lender will offer; or
• make lending decisions.

These matters are determined by the relevant broker or lender under its own assessment processes, policies and eligibility requirements.

A funding partner may request additional information, documents or verification from you and may conduct credit enquiries or other checks as part of its assessment.

5. No guarantee of funding

Business Loans Connect does not guarantee:

• that you will be approved for finance;
• that a funding partner will offer finance;
• any particular finance amount;
• any particular interest rate, fee or repayment;
• any particular finance terms;
• the availability of a particular finance product; or
• that funding will be provided within a particular timeframe.

References on our website or advertising to possible funding amounts or funding timeframes describe options that may be available through participating providers. Actual availability depends on the relevant provider, your circumstances, eligibility and approval.

6. Information you provide

When submitting information to Business Loans Connect, you agree that:

• the information you provide is accurate and truthful to the best of your knowledge;
• you are authorised to provide information about the relevant business;
• you will not knowingly provide false, misleading or fraudulent information; and
• you are making an enquiry for a genuine business purpose.

If information provided is incomplete or inaccurate, we or a participating funding partner may be unable to process your enquiry.

7. Sharing your enquiry with a funding partner

If your enquiry meets our initial referral criteria, you authorise Business Loans Connect to disclose the information you have provided to a participating business finance broker or lender for the purpose of responding to and assessing your business finance enquiry.

The participating funding partner may contact you using the contact details you provide.

Our collection, use and disclosure of personal information is explained further in our Privacy Policy.

The funding partner that receives your information is responsible for its subsequent handling of your information in accordance with its own privacy obligations and privacy policy.

8. Third-party providers and websites

Funding products and finance services are provided by third parties, not by Business Loans Connect.

After completing an enquiry, you may be provided with a link to, or automatically redirected to, the website or application process of the participating funding partner assigned to your enquiry.

When you leave the Business Loans Connect website and interact with a third-party website or provider, that provider's own terms, privacy policy and other conditions apply.

Business Loans Connect does not control third-party websites and is not responsible for their availability, security, content or subsequent changes.

9. Referral fees and commissions

Business Loans Connect may receive a referral fee, commission or other payment from a participating funding partner in connection with an introduction or resulting finance transaction.

You are not charged a fee by Business Loans Connect for submitting an enquiry through our website unless we expressly tell you otherwise before you incur that fee.

The existence of a commercial relationship between Business Loans Connect and a funding partner does not mean that we guarantee, endorse or recommend a particular finance product.

10. Use of technology

Business Loans Connect uses technology to collect, manage and distribute enquiries.

Our systems may use information you provide to:

• determine whether an enquiry meets our initial referral criteria;
• identify duplicate or repeat enquiries;
• manage enquiries; and
• distribute eligible enquiries within our participating funding partner network.

These systems do not make lending decisions, determine your creditworthiness, approve or decline finance, or set finance rates or terms.

11. Website use

You must not use the Business Loans Connect website:

• for an unlawful or fraudulent purpose;
• to submit information that you know is false or misleading;
• to interfere with the operation or security of the website;
• to attempt to gain unauthorised access to our systems;
• to introduce malicious software or harmful code; or
• in a way that infringes the rights of Business Loans Connect or another person.

We may take reasonable steps to restrict access to the website where we reasonably believe it is being misused.

12. Website content and intellectual property

Unless otherwise stated, content on the Business Loans Connect website, including our branding, text, graphics, website design and other materials, is owned by or licensed to Square Digital Pty Ltd.

You may view and use website content for your own legitimate business finance enquiry.

You must not reproduce, commercially exploit or distribute our website content without permission, except where permitted by law.

Third-party names, logos and trademarks remain the property of their respective owners.

13. Website availability and information

We take reasonable steps to keep information on our website accurate and our services available.

However, information may change and our website may occasionally be unavailable due to maintenance, technical issues or circumstances outside our reasonable control.

You should verify important information about a finance product directly with the relevant broker or lender before entering into any finance arrangement.

14. Liability

Participating funding partners operate independently of Business Loans Connect. Once an enquiry has been referred to a participating funding partner, that funding partner is responsible for its own communications, assessments, advice, representations, services, privacy practices, lending decisions, finance products and dealings with you.

To the maximum extent permitted by law, Business Loans Connect is not responsible for the independent acts, omissions, representations, advice, decisions or conduct of a participating funding partner, or for any finance product or service provided by that funding partner.

To the maximum extent permitted by law, Business Loans Connect and Square Digital Pty Ltd are not responsible for losses caused by:

• a decision made independently by a participating broker or lender;
• the approval, refusal, withdrawal or terms of a third-party finance offer;
• inaccurate or incomplete information provided by you or a third party;
• your decision to enter into or not enter into a finance arrangement with a third party; or
• circumstances outside our reasonable control.

Nothing in these Terms excludes, restricts or modifies any right, guarantee, condition, remedy or liability that cannot lawfully be excluded, restricted or modified.

15. Privacy

We handle personal information in accordance with our Privacy Policy.

Our Privacy Policy explains the types of personal information we collect, how we use and disclose it, how we protect it, and how you can request access or correction or make a privacy complaint.

16. Changes to these Terms

We may update these Terms from time to time to reflect changes to our services, website, business practices or legal obligations.

The current version will be published on our website with its last-updated date.

Changes will apply from the date the updated Terms are published and will not retrospectively alter rights or obligations that have already arisen unless required or permitted by law.

17. Governing law

These Terms are governed by the laws of Queensland, Australia.

You submit to the non-exclusive jurisdiction of the courts of Queensland and courts entitled to hear appeals from those courts.
